These Terms & Conditions (“Terms”) apply to all pedigree consulting and advisory services (“Services”) supplied by Grand Prix Pedigrees (“we”, “us”, “our”) to a client (“you”, “your”). By submitting the consulting questionnaire, paying for a consulting package, or otherwise engaging our Services, you confirm that you have read, understood, and agreed to be bound by these Terms.
1. Services
Grand Prix Pedigrees provides written pedigree analysis, suggested mating recommendations, and related advisory services based on the information you supply via the consulting questionnaire and our research. The exact scope, format, and depth of each engagement is described in the consulting package you purchase. Reports are compiled and sent to the purchaser in a PDF format.
2. Fees and Payment
Fees for each consulting package are as displayed at the time of purchase and are payable in full in advance. Work on a consultation will not commence until payment has been received and the questionnaire has been completed in full.
3. Turnaround
Indicative turnaround times are provided in good faith and may vary depending on the complexity of the request, the completeness of the information supplied, and current workload. We aim to have turnaround time around a week for an Intensive Pedigree report and up to two weeks for the Intensive Pedigree Report + Mating suggestions. We will endeavour to keep you informed if delivery is likely to be delayed.
4. Client Responsibilities
You are responsible for ensuring that all information supplied to us, including mare details, breeding history, and goals, is accurate and complete. We rely on the information you provide and are not responsible for advice that is materially affected by inaccurate or incomplete information.
5. Cancellations and Refunds
Because consulting work is bespoke and begins as soon as your questionnaire is received, fees are generally non-refundable once work has commenced. If you wish to cancel, please contact us as soon as possible. Refunds outside of statutory consumer guarantees are at our sole discretion.
6. Intellectual Property and Use of Reports
All written reports, recommendations, and other materials we provide remain our intellectual property. You are granted a non-exclusive, non-transferable licence to use the materials for your own personal breeding decisions. You may not republish, resell, or distribute our reports, in whole or in part, without our prior written consent.
7. Confidentiality
We will treat the information you supply about your horse(s) and breeding plans as confidential and will not share it with third parties except as required to deliver the Services or as required by law.
8. Disclaimer
Any information, analysis, or recommendations provided by Grand Prix Pedigrees are offered as an educated opinion based primarily on pedigree research and historical breeding data.
Breeding recommendations and suggested matings are largely based on pedigree considerations alone and may not take into account the physical characteristics, conformation, health, temperament, performance ability, management, or environmental factors of the client horse or any proposed mating partner.
Suggested stallions or breeding options may not take into account, and Grand Prix Pedigrees is not responsible for: lameness, skeletal, or genetic issues of individual horses; semen quality, fertility, availability, commercial value, pricing, transport; or any contractual or logistical arrangements associated with breeding services.
Breeding a quality horse involves numerous variables beyond pedigree compatibility. Pedigree analysis represents only one component of a successful breeding outcome, and results can vary significantly. Additionally, it may require multiple matings of the same combination to achieve a desired result.
Accordingly, Grand Prix Pedigrees accepts no responsibility or liability for the outcome of any breeding decisions, matings undertaken, or offspring produced as a result of information or recommendations provided. All breeding decisions remain the sole responsibility of the client.
9. Limitation of Liability
To the maximum extent permitted by law, our total aggregate liability to you in connection with the Services, whether in contract, tort (including negligence), or otherwise, is limited to the fees actually paid by you for the specific consultation giving rise to the claim. We exclude all liability for indirect or consequential loss, including loss of profits, loss of opportunity, or loss arising from the performance, value, fertility, soundness, or saleability of any horse.
10. Changes to These Terms
We may update these Terms from time to time. The version in effect at the date you submit your questionnaire and pay for your consultation is the version that applies to that engagement.
11. Governing Law
These Terms are governed by the laws of Australia. Any dispute arising under or in connection with these Terms is subject to the non-exclusive jurisdiction of the Australian courts.
